A registered trademark is a property right.
The title to the trademark rights is claimed when an application to register a trademark is made.
Following formal trademark registration, then you are entitled to use the registered symbol with the mark, like the "R" in our BATTLE® trademark.

Because title is established when a trademark is registered, it can be used
- to control use,
- to limit use by parties who do not have permission,
- to obtain royalty payments,
- in licences,
- in a company's balance sheet,

Registered trademarks are exclusive
A registered trademark exclusively belongs to its owner for the goods/services registered for the territory covered. This means:
- a registered trademark cannot be used without the owner's permission,
- a registered trademark cannot be copied for similar goods/services,
- a registered trademark cannot be used on counterfeit goods,
- a registered trademark cannot be used by competitors.

Because title is established when a trademark is registered, it can be used

- to signal quality to customers,
- to convey your trademark as a badge of origin.
Registered trademarks can be extended into other countries
Ireland and the EU are parties to agreements that allow owners of registered trademarks to register their marks in other countries. This means:
- the registered trademark can be widened to cover additional countries, provided it has not been registered there,
- opportunities for licensing can be expanded,
- potential for increasing exports and sales can be managed under the brand,
- a successful registered trademark can be extended. Priority is avaialble for the first six months after making an application for registration in Ireland or the Eu to expand registartions in 76 countries under the Madrid Protocol.
Registered trademarks can reduce the chances of being sued
Because title is established when a trademark is registered, it can be used
- to establish ownership rights,
- to show customers the brand is worthwhile,
- to obtain some assurance that it has been legally grounded,
- to prevent another party from seeking to close down your business because they hold a registered trademark or through allegations of infringement.
